3. DMCA Takedown Notice Requirements

To be valid under the DMCA, your written notice must include all of the following information:

1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
2. Identification of the infringing material: A description of the material you claim is infringing and that you want removed or access to which you want disabled, with enough detail to allow us to locate the material (e.g., the specific URL or stream identifier).
3. Your contact information: Your full name, mailing address, telephone number, and email address.
4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
5. Accuracy statement: A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the copyright owner.
6. Physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.

Notices that do not comply with all of these requirements may not receive a response. We recommend consulting a legal professional before submitting a DMCA notice.

4. Counter-Notification Process

If you believe that content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our designated copyright agent. A valid counter-notification must include:

1. Your physical or electronic signature
2. Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before removal
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
4. Your name, address, telephone number, and email address
5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the US, any judicial district in which XtremeIPTV HD may be found) and that you will accept service of process from the person who provided the original DMCA notice or their agent

Upon receipt of a valid counter-notification, we will forward a copy to the original complainant and may restore the removed material within 10–14 business days unless the copyright owner files a court action to restrain the activity.

5. Repeat Infringers Policy

In accordance with the DMCA and applicable law, XtremeIPTV HD maintains a policy of terminating, in appropriate circumstances, the accounts of users who are found to be repeat infringers of intellectual property rights.

We reserve the right to terminate the account of any user who has been the subject of multiple valid DMCA notices, at our sole discretion and without prior notice. Such termination will be without refund.
